Overtime Calculation Under the New Labour Codes
Since 21 November 2025, overtime in most workplaces falls under the Occupational Safety, Health and Working Conditions Code, 2020. Overtime applies once a worker crosses 8 hours in a day or 48 hours in a week, it is paid at twice the ordinary rate of wages, and overtime is capped at 125 hours a quarter.
A common way to work it out for monthly-paid staff:
Overtime pay = (monthly wage ÷ 26 ÷ 8) × 2 × overtime hours
Example: A worker earns ₹20,800 a month and works 10 overtime hours. Hourly rate = 20,800 ÷ 26 ÷ 8 = ₹100. Overtime pay = 100 × 2 × 10 = ₹2,000.
